About
“Elver” is the Norwegian word for rivers. Since ancient times, rivers have connected people, enabled trade, and carried communities forward. That idea is central to the firm’s work: guiding clients through complex legal systems with clarity and purpose.
Eric Aaserud helps companies engage confidently with government agencies, focusing on government contracting issues, including False Claims Act risk mitigation, federal data rights and IP protection, GSA Schedule contracts, commercial item contracting, subcontract negotiation, and contract compliance.
With over 20 years of AmLaw 100 firm experience, Eric has represented clients ranging from early-stage ventures to Fortune 500 companies across all phases of government contracting. His work includes negotiation, bid protests, contract claims, government investigations, and audits. He also has extensive experience handling government contracts issues during mergers and acquisitions.
As the founder of a boutique firm, Eric works closely with each client to deliver focused, senior-level counsel without the overhead or rigidity of a large firm. The firm supports growth-stage contractors, innovative product companies, and global corporations navigating U.S. federal systems.
Projects include:
- Handling a complex, state-level breach-of-contract matter arising from a competitively awarded public procurement, focused on post-award delivery refusal and shifting administrative requirements.
- Advising a client through a Stop Work Order and Termination for Convenience under a USAID subcontract, including preparation of cost submissions.
- Reducing GSA OIG audit exposure from a prior multi-million-dollar settlement (before the firm’s involvement) to a recent audit result near $0—a rare outcome achieved through transparent pricing disclosures and disciplined internal controls.
- Leading a federal contracting gap analysis for a large-cap, publicly traded company: reviewing FAR and agency supplement clauses, identifying compliance strengths, and implementing refinements to strengthen contract performance.
- Guiding a client through FAR flowdown negotiations, limiting subcontractor clause acceptance to only those mandatory or necessary under the prime contract—helping avoid over-acceptance risks and compliance pitfalls.
- Overturning an SBA size determination on behalf of an Alaska Native Corporation, preserving its eligibility for small business set-asides.
- Successfully challenging the U.S. Army’s award of a mechanics tool kit contract at GAO after the client was improperly excluded from consideration.
- Achieving a favorable remand and ultimate reversal of an Army decision denying a veteran’s medical retirement benefits, securing benefits for the client.
- Updating a client’s export control framework by integrating document controls, subcontractor compliance, and ITAR/EAR protocols into a comprehensive plan.
- Supporting a small business entering the federal market: developing teaming strategies, advising on FAR/DFARS compliance, and positioning the company for base operations work.
Eric shares insights through presentations and publications for organizations such as the Practising Law Institute, the National Contract Management Association, and the American Bar Association.
